You lose xp when you fail. It also always succeeds when you're in the travel agency.

Losing xp is by design. It's... not the best system.

A DM told me 'losing' xp was not intended and I should report this.

Stuff on that page is out of date though and references stuff that, again, i've been told (and observed) arn't things anymore.

There's a lot of old stuff there, true (mainly the party and item restrictions), but it's the only official information about pickpocketing that is readily found.

This is working the way it was designed (no claims on how good it is) so I am closing this. We've gone back and forth about redesigning the skill, but nothing is firm yet. Keep an eye out in the future though.
